Seller Terms

1.   SELLING

1.1   These PLAI (Pte.) Ltd. Team “Shop” Use Terms are in addition to, and operate concurrently with, the PLAI (PTE.) LTD. END USER LICENSE AGREEMENT and the PLAI (PTE.) LTD. PRIVACY POLICY

1.2   Permission to sell on or via the PLAI SPORT MOBILE APPLICATIONS or WEB PORTAL is conditional upon you as either the Buyer or the Seller (“you”) agreeing to the terms and conditions set out in this PLAI (PTE.) LTD. Team Shop Use Terms (“Team Shop Use Terms”) and the PLAI (PTE.) LTD. END USER LICENSE AGREEMENT. If you do not wish to accept the Team Shop Use Terms and the PLAI (PTE.) LTD. END USER LICENSE AGREEMENT, you must not click “I Accept” and you must not use any PLAI (Pte.) Ltd. web or mobile products. Notwithstanding the foregoing:

1.3   if you have previously agreed to accept the PLAI (PTE.) LTD. END USER LICENSE AGREEMENT then notwithstanding that you do not click “I Accept” you will continue to be bound by the PLAI (PTE.) LTD. END USER LICENSE AGREEMENT and you may continue to use the Applications – though not for the purpose of selling or advertising products and services; and

1.4   any use by you of the Applications will be considered to be in accordance with the terms and conditions of these Team Shop Use Terms and the PLAI (PTE.) LTD. END USER LICENSE AGREEMENT.

1.5   By clicking on the “I Accept” button on any PLAI mobile or web solution, you confirm your agreement with PLAI (PTE.) LTD. (“us” or “we”) to:

            a.   these Team Shop Use Terms; and

            b.   the PLAI (PTE.) LTD. END USER LICENSE AGREEMENT; and

            c.   the PLAI (PTE.) LTD. PRIVACY POLICY

2.   PROVISIONS RELATING TO SELLERS

2.1   Definitions and Interpretation

2.1.1   In this clause 2 the following words and expressions shall have the following meanings:

Applications” has the meaning given to it in the PLAI (PTE.) LTD. END USER LICENSE AGREEMENT;

Buyer” includes a person who places an order for an item sold or offered for sale by the Seller via the Applications or from the Applications;

PLAI (PTE.) LTD. END USER LICENSE AGREEMENT” means the PLAI (PTE.) LTD. End User License Agreement as varied from time to time and may be viewed via the PLAI website at www.plaisport.com

Listing Policy” means our listing policy as amended from time to time and may be viewed at the end of this document

Prohibited Items List” means the list of prohibited items maintained by us which lists items which the Seller must not sell via the Applications. The Prohibited Items List may be viewed toward the end of this document.

Seller” means a person offering the Item for sale via the Applications;

3.   FORBIDDEN DEALINGS

3.1   You shall not offer for sale any Item:

          a.   which you are not legally able to sell, or which you cannot sell to the Buyer free from all charges liens and encumbrances;

          b.   which is within our Prohibited Item List or which is in contravention of any law or regulations governing the sale of the same;

          c.   the get-up, production and sale of which infringes any copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy or any other form of property or proprietary rights, whether intellectual or otherwise;

          d.   which contains defamatory, trade libellous, unlawfully threatening or unlawfully harassing statements whether such statements be in the form of words, drawings, photographs, 3-dimensional representations or otherwise; or

          e.   which is obscene or contains pornography of any kind.

          f.   By offering an item for sale on via the Applications, you, as the Seller, are warranting and undertaking to us and all Buyers that:

          g.   you do not and will not engage in the forbidden dealings set out in clause 2.2 above;

          h.   the information supplied by you is correct and accurate in all material respects and shall not:

          i.   contain defamatory, trade libellous, unlawfully threatening or unlawfully harassing statements;

          j.   contain obscene material or pornography of any kind;

          k.   contains any adults only material or element or is otherwise harmful to minors;

          l.   contain any viruses, trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; or

          m.   contain any hyperlinks unless permitted by us;

           n.   the items offered for sale by you are not within the Prohibited Item List;

          o.   you will not list or offer or sell any item which, by paying to us any fees, could cause us to violate any applicable law, statute, ordinance or regulation.

3.2   You must not link directly or indirectly to or include descriptions of goods or services that:

          a.   are prohibited for sale under this Agreement;

          b.   you do not have a right to link to or include.

4.   SALES

4.1   If you receive an order for an item sold via the Applications then you:

          a.   are obligated to complete the transaction with the Buyer unless:

          b.   you cannot authenticate Buyer’s identity; or

          c.   the Buyer fails to meet the terms of payment as stipulated by you in your listing;

          d.   must confirm the total due for the order (including shipping) and send the Buyer an “Receipt”. In most cases, this Receipt will be automated by PLAI (PTE.) LTD. systems however it is your responsibility to ensure this is delivered to the purchaser.

4.2   Caution re: Completion of Sale;

4.2.1   We do not warrant that any Buyer will complete the purchase of an item herein. You are urged to be aware of the risk of dealing with foreign nationals, underage persons or people acting under false pretence or persons having no contracting capacities.

4.3   Right to require withdrawal of an item;

4.3.1   We shall have the absolute and unfettered right to withdraw any item you offer for sale through the Applications without notice or compensation to you. Without derogating from this right, we shall have the right to withdraw an item if:

          a.   the item is within our Prohibited Items List;

          b.   you are determined by us to have breached this Agreement or your user account is suspended by us pursuant to the terms of this Agreement;

          c.   we are unable for any reason whatsoever to verify or authenticate any information provided by you; or

          d.   an item offered for sale by you is in breach of our Listing Policy, which can be at the end of this document. The Listing Policy may be updated by us from time to time.

5.   FEES

5.1   We reserve the right to change the fees charged for any of our services at any time. In the event that we introduce a new service, the fees for that service are effective at the launch of the service, unless otherwise stated.

5.2   All fees are exclusive of relevant taxes in your jurisdiction and are in the currency of your domicile.

5.3   You acknowledge and agree that we may be paid a commission or fee for the operation of store fronts on the Applications and/or sales made by you via the Applications or any payment gateway used by you or the Applications.

6.   PROHIBITED ITEMS LIST

6.1   The following list is not intended to be an exhaustive statement of prohibited and restricted items that you may not advertise for sale or sell through the Applications.

          a.   Alcohol
          b.   Animal Traps – Steel Jaw/Foot Hold
          c.   Animals, Animal Products, Organs or any Body Parts
          d.   Artefacts and Heritage Items
          e.   Adult Related Items
          f.   Copyright-infringing, Replica and Counterfeit Items
          g.   Downloadable Media
          h.   Drugs
          i.   Food
          j.   Fireworks
          k.   Lock Picking Devices
          l.   Noxious Weeds
          m.   OEM Software
          n.   Police and Emergency Services Related Items
          o.   Postage Stamps
          p.   Radio Communications Devices
          q.   Real Estate
          r.   Stolen Goods
          s.   Tickets Over Face Value
          t.   Therapeutic Goods
          u.   Tobacco
          v.   Used Clothing
          u.   Used Cosmetics
          x.   Weapons, Knives and Firearms or Ammunition

7.   LISTING POLICY

7.1   Sellers must not:

          a.   misrepresent the location from which the item will be posted.
          b.   include titles which are misleading or do not accurately describe the item for sale.
          c.   offer a catalogue or other publication from which buyers may order directly.
          d.   charge excessive postage and handling for items.
          e.   offer the opportunity through the Applications to purchase the item or other merchandise outside of the Applications.
          f.   solicit buyers to use payment methods not specifically permitted by PLAI (PTE.) LTD. as accepted payment methods.
          g.   create a listing that does not offer an item or service for purchase.
          h.   use profanity in a listing.
          i.   inappropriately use brand names or other words to attract buyers to a listing.

8.   REFUND POLICY

8.1   PLAI is committed to providing a full resource for teams, clubs and organisations to manage their program. Occasionally, this will include the execution of refunds to purchasers who need to reverse a transaction that they have made to their team.

8.2   On activation of the PLAI (PTE.) LTD. Team Shop, the activating team/club/user agrees on behalf of their organisation and in the capacity of an administrator to said organisation, to the Refund Policy here marked within the PLAI Seller Terms.

8.3   Further, on the execution of a purchase by a team/club/organisation member or user, the purchaser agrees to the Refund Policy marked here within the PLAI Seller Terms.

8.4   PLAI charges a small fee on the sale item value for the delivery of the Team Shop service to teams/clubs/organisations. This fee varies depending on the region/domicile of the transaction. More information on these fees can be found in the PLAI General Terms and Conditions located at https://www.plaisport.com/

8.5   Additionally, STRIPE charges a small fee on the sale item value for the delivery of the transaction. This is separate to the fees mentioned in clauses (5b) and (5c) above and varies depending on the region/domicile of the transaction. More information on these fees can be found in the PLAI General Terms and Conditions located at https://www.plaisport.com/

8.6   When a Refund is requested by a user to their team/club/organisation administrator, the team/club/organisation will be required to refund the specific user purchase via their STRIPE dashboard or, in future cases and post integration, directly via the PLAI (PTE.) LTD. web or mobile product.

8.7   Both the team/club/organisation administrator and the user accept that:

          a.   The PLAI charge to the team/club/organisation on every transaction is non-refundable. This is typically between 0.9-3.4% of the transaction value depending on region/domicile of the transaction.

          b.   The STRIPE charge to the team/club/organisation on every transaction is non-refundable. This is typically between 0.9-3.4% of the transaction value depending on region/domicile of the transaction.

          c.   The transaction fee paid by the purchaser at check out is non-refundable.

          d.   Typically, the total fee held by PLAI and STRIPE as a collective will not exceed 4.5% of the total transaction amount and is less in most regions.

          e.   The total refundable sum, therefore, will be approximately 95.5% of the original transaction value. This is accepted by both the buyer and seller when buying or selling on the PLAI mobile & web platforms.

          f.   Should the selling team/club/organisation wish to refund 100% of the purchase price to the buyer in the event of a Refund, the team/club/organisation accept and agree to absorb the transaction fees that PLAI & STRIPE require for the delivery of the service.

8.8   Once a refund has been executed by a team/club/organisation administrator via the STRIPE dashboard of said organisation, it could take additional time for your financial institution to make funds available in your account. Typically, this shouldn’t take longer than 3-5 working days, however in some cases, it can take up to 4 weeks.
